本報告書は、相手国が投資家の保護義務に違反した場合に投資家が直接相手国に対し国際仲裁を申し立てて救済を求めることができる紛争解決条項（ISDS条項）への批判を受け創設されたEU及びブラジルでの新たな紛争解決制度（常設投資裁判所、国家間仲裁手続）を整理するとともに、特にEUの常設投資裁判所制度のICSID条約及びEU法との整合性等につき行った調査結果をまとめたものである。
